The English version of these terms governs. Where a translated version exists elsewhere and the two disagree, this English version is the one that applies.
1. Who we are
OUTSTAY is a travel booking platform operated by OUTSTAY. We act as a booking facilitator/broker between you and the underlying supplier — the airline, hotel or villa host, bus or cab operator, rail system, insurer, visa processing partner, tour operator, private-jet or houseboat/cruise operator — for each booking you make through us. We do not operate aircraft, vessels, vehicles, or accommodation ourselves, and the underlying supplier's own conditions of carriage/stay apply in addition to these terms.
2. Your account
You need an account, verified by a one-time code sent to your phone or email, to book on OUTSTAY. You're responsible for keeping your login secure and for all activity under your account. High-value actions — cancelling a paid order, deleting your account — require a fresh verification code at the time of the action.
3. Searching, holding, and booking
Search results reflect availability and pricing returned by the relevant supplier or provider at the moment you search, and can change before you complete a booking. Selecting a result places a short, time-limited hold; a booking is only confirmed once payment is completed and the supplier has accepted it. If a supplier cannot fulfil a confirmed booking after payment (a rare provider-side failure), we automatically refund the payment in full.
4. Pricing, taxes, and payment
Displayed prices include applicable Indian GST at the rate that applies to that product category, shown at checkout before you pay. Card and other payment details are captured directly by our payment processing partner's own secure fields — OUTSTAY's own servers never receive or store your full card number, CVV, or expiry. If this deployment is running in a preview/demo environment, payments are simulated and no real money moves; a visible banner discloses this whenever it applies.
5. Cancellations and refunds
See our Refunds & Cancellation Policy for exactly what happens, by product category, when you cancel a paid order — it is generated from our actual booking system rather than generic language, and governs over anything summarized here.
6. Acceptable use
Don't use OUTSTAY to make fraudulent bookings, misuse promotional offers, scrape or automate access to the platform outside a documented API, or attempt to circumvent our fraud, security, or rate-limiting controls. We may suspend or close an account that does.
7. Corporate/organisation accounts
Where your account belongs to an organisation with a configured approval or spend policy, your bookings may require an approver's sign-off or may be blocked by a spend cap before payment — this is configured by your organisation's own administrator, not by OUTSTAY.
8. Liability
OUTSTAY facilitates your booking with the underlying supplier; we are not liable for the supplier's own acts, omissions, delays, cancellations, or the quality of the travel service itself, beyond our obligations as a facilitator under applicable Indian consumer protection law. Nothing in these terms limits liability that cannot lawfully be limited.
9. Changes to these terms
We may update these terms as the platform changes. Continued use of OUTSTAY after an update means you accept the revised terms.
10. Governing law and disputes
These terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts at the location of our registered office.
